Chapter 7 Advantages

Why Chapter 7?

Advantages of Chapter 7 bankruptcy include:

  • "Discharges" or wipes out some – if not all – debts that you do not want to pay including credit cards, medical bills, deficiencies and the like.

  • Immediately stops foreclosures, bill collectors, lawsuits and repossessions.

  • You receive a complete fresh start. After the bankruptcy is discharged the only debts you owe will be for secured assets on which you choose to reaffirm; however, there are limited exceptions like child support obligations and debts incurred for fraud. Call us at 877-886-5955 to discuss your specific situation to identify any debts that may be excepted from discharge.

  • You have immediate protection against creditor’s collection efforts and wage garnishment on the date of filing.  But realize that for some limited debts like child support that are not discharged, those efforts may restart after your discharge.  Call us at 877-886-5955 to discuss possible exceptions and whether Chapter 13 might be a better way to deal with these exceptions.

  • Wages you earn and property you acquire -- with limited exceptions for inheritances for a brief period of time -- after the bankruptcy filing date are yours, not the creditors or bankruptcy court.

  • There is no minimum amount of debt that you must have nor is there a limit on the maximum amount of debt you can have.  Simply, you can file Chapter 7 regardless of what you owe.

  • Its quick.  Chapter 7 cases are typically finished and completely discharged in roughly three to six months.  Chapter 13 normally takes at least three years.

  • Sometimes you don't have a choice.  If you don't make enough money to fund a Chapter 13 Plan, you have no choice and must file a Chapter 7 instead of Chapter 13.

Call us 24/7 toll free at 877-886-5955 for a free consultation with one of our experienced bankruptcy lawyers and so we can answer any questions that you have.

This is not intended as legal advice to you because Chapter 7 is complicated and depends on your specific circumstances.  If you are considering a Chapter 7, call us toll free at (877) 886-5955 for a free consultation so we can provide legal advice tailored and specific to your unique situation.  There is no obligation and the call is confidential.
